4.3 No Guarantee of Results

We do not guarantee any specific results from using our educational Services. Financial outcomes depend on various factors, including individual circumstances, market conditions, and personal implementation of concepts learned.

5. Payments and Refunds

5.1 Fees and Payment

Some of our Services require payment. By purchasing our paid Services, you agree to pay the fees indicated for such Services. All fees are quoted in South African Rand (ZAR) and are inclusive of applicable taxes unless otherwise stated.

5.2 Payment Processing

We use third-party payment processors to facilitate payment transactions. Your use of these payment services is subject to the applicable terms and policies of these third-party providers.

5.3 Refund Policy

Our refund policy varies depending on the specific Service purchased:

Workshops and In-Person Events: Cancellations made at least 14 days before the scheduled event may receive a full refund. Cancellations made 7-13 days before the event may receive a 50% refund. No refunds will be issued for cancellations less than 7 days before the event.
Digital Learning Subscription: You may cancel your subscription at any time. Refunds are not provided for partial subscription periods.
Corporate Programs: Refund terms for corporate programs are specified in the individual service agreements.

6. Intellectual Property Rights

6.1 Ownership

All content, materials, and resources provided through our Services, including but not limited to text, graphics, logos, images, audio, video, software, and educational materials (collectively, "Content"), are owned by or licensed to FinLit Safari and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our Services and Content for your personal, non-commercial educational purposes.

6.3 Restrictions

We do not actively monitor User Content but reserve the right to review and remove any User Content that violates these Terms or that we find objectionable, without prior notice.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT OUR SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINLIT SAFARI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE OUR SERVICES
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OUR SERVICES
ANY CONTENT OBTAINED FROM OUR SERVICES
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO FINLIT SAFARI FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless FinLit Safari and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of our Services, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Miscellaneous

14.1 Entire Agreement

These Terms constitute the entire agreement between you and FinLit Safari regarding our Services and supersede any prior agreements.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
